NBA® 2K26's "King of the Court" Weekly Tournament (“Contest”) Presented by AT&T
Contest may only be entered in or from the 50 United States & D.C. (excluding CO and MD), Australia, Canada (excluding Quebec), Chile, Denmark, Metropolitan France, Germany, Great Britain (England, Wales and Scotland only), Greece, Greater China, Indonesia, Israel, Japan, Mexico, New Zealand, Norway, Philippines, Portugal, Republic of Ireland, Singapore, South Africa, South Korea, Spain, Sweden, Switzerland, Thailand, and Turkey, and entries originating from (i) individuals not residing within the preceding jurisdictions or (ii) any other jurisdiction are not eligible for entry. This Contest is governed exclusively by the laws of the United States subject to the enforcement of the mandatory provisions of any other applicable law.
Please read these Official Rules carefully before participating as they are binding on all participants. In particular, Sponsor (as defined below) draws attention to the limitations and exclusions of liability and releases in sections 6, 9 and 10, the requirements for claiming a prize in section 7 and the grant of publicity rights in section 11.
1. Eligibility. Participation open only to legal residents of the 50 United States & D.C. (excluding CO and MD), Australia, Canada (excluding Quebec), Chile, Denmark, Metropolitan France, Germany, Great Britain (England, Wales and Scotland only), Greece, Greater China, Indonesia, Israel, Japan, Mexico, New Zealand, Norway, Philippines, Portugal, Republic of Ireland, Singapore, South Africa, South Korea, Spain, Sweden, Switzerland, Thailand, and Turkey (collectively, “Eligible Jurisdictions”), who are at least 18 years of age and have attained the age of majority in their state, country or province of residence at the time of entering the Contest (For clarity, the ages of majority for various jurisdictions are as follows: (i) Alabama – 19; (ii) Nebraska – 19; (iii) Mississippi – 21; (iv) New Zealand – 20; (v) Thailand – 20;and (vi) Japan - 20); (vii) in Canada: British Columbia, New Brunswick, Nova Scotia, Newfoundland & Labrador, Yukon, Northwest Territories and Nunavut - 19. Void in Colorado, Maryland, Quebec, outside of an Eligible Jurisdiction and where prohibited or restricted by law. Proof of residency and age may be required. Players must enter the Contest from within an Eligible Jurisdiction. Entries originating from jurisdictions outside of the Eligible Jurisdictions are void. Employees, officers and directors of 2K Games, Inc. (located at 10 Hamilton Landing, Novato, CA 94949, USA) (“Sponsor”), NBA Properties, Inc., the National Basketball Association, the Women’s National Basketball Association, NBA Media Ventures LLC, NBA TV LLC, and the NBA & WNBA member teams (collectively “the NBA Entities”), the National Basketball Players Association, the Women’s National Basketball Players Association, the National Football League Players Association (as licensing agents for the Women’s National Basketball Players Association), the NBA 2K League (current and past players are not considered employees and are eligible to enter), Microsoft Corporation, Sony Computer Entertainment America LLC, Nintendo Co. Ltd., Valve Corporation, AT&T Inc.(collectively, the “Contest Parties”) and their respective parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Contest materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. Contest is subject to all applicable federal, provincial, state and local laws and regulations.
2. Contest Dates and Phases.
Contest Period. Weekly Contests will take place between September 12, 2025 and August 2, 2026 (“Contest Period”).
Weekly Contests. The Contest Period will be divided into separate and distinct weekly contest, with each week beginning at 12:01 a.m. United States Pacific Time (“PT”) on Monday and ending at 11:59 p.m. PT on the following Sunday (each, a “Weekly Contest Period”).
Weekly Qualifying Periods and Weekend Competition Periods. Each Weekly Contest Period will have a weekly qualifying period beginning at 12:01 a.m. PT on Monday and ending at 11:59 p.m. PT on the following Thursday (each, a “Weekly Qualifying Period”) and a weekend competition period beginning at 3:01 p.m.PT on Friday and ending at 11:59 p.m. PT on Sunday (“Weekend Competition Period”).
Days and times for any Weekly Contest and/or the Weekly Qualifying Period or Weekend Competition Period are subject to change at the discretion of Sponsor. In the event of any change, notice will be posted on the Contest page https://nba.2k.com/2k26/king-of-the-court/.
For the avoidance of doubt, MyTEAM REP earned to gain qualification and GameScores will not carry forward into subsequent Weekly Contests.
3. How to Compete.
a. Contest Structure and Tracks: Contest will consist of three (3) separate tracks (each a “Track”):
Track 1 for players playing PS5 and Xbox Series consoles.
Track 2 for players playing Switch 2.
Track 3 for players playing PC.
b. Contest Requirements: To enter the Contest, players must meet the eligibility requirements set forth in Section 1 above. This Contest is a game of skill and chance does not play a part in the determination of the winner. To participate in the Contest, players must at their own expense (i) own or have access to NBA® 2K26 (the “Game); (ii) have internet connection (while broadband internet access is not required, it is recommended) and (iii) own or have access to:
If playing on Xbox, a Gamertag and Xbox Gold Service;
If playing on Switch 2, the Nintendo Online server; or
If playing on PS, PSN ID and PS Plus service.
Entrants must play under the same account and on the same platform throughout the duration of any Weekly Contest Period. A player cannot participate in more than one (1) Track during any Weekly Contest or Weekend Competition Period.
No automated devices and/or programs permitted.
Players suspected of being in violation of these Official Rules will be subject to disqualification. All aspects of this Contest are subject to these Official Rules.
(c) To set up a franchise in MyTEAM mode:
o Sign up for or log on to your NBA 2K account (“2K Account”) in the Game and select “MyTEAM” from the Main Menu.
o After the Game launches in MyTEAM mode, you will play a game controlling 5 players. After the game has ended, you will select three (3) of ten (10) available starter pack player cards and then you will open your Starter Kit (“Starter Kit”). Your Starter Kit will contain enough MyTEAM cards to complete your first Lineup, and then you will choose your team (“Team”) name.
If you start your MyTEAM from the MyCAREER mode, you will first enter the Triple Threat Park building in The City. You will select three (3) of ten (10) available starter pack player cards and then enter Triple Threat Park.
(d) To qualify for a Weekend Competition Period:
To qualify for a Weekend Competition Period for the Track selected, players must earn MyTEAM REP within the MyTEAM mode and fill a progress bar during the corresponding Weekly Contest Period. REP is earned by playing any of MyTEAM's game modes, except for Play With Friends and some Challenge games (namely tutorial games). The progress bar will reset following the conclusion of the applicable Weekly Qualifying Period and players will need to refill it during the next Weekly Qualifying Period to participate in the next Weekend Competition Period.
(e) Weekend Competition Period Winner Determination:
For every game played within “King of the Court” mode during the applicable Weekend Competition Period (each, a “Qualifying Game”), players will earn a GameScore. Players will only be able to count the Top 4 GameScores earned during that Weekend Competition Period (“Total Score”). If a player earns a better score in their 5th or subsequent Qualifying Games, their lowest score will be replaced with their better score. The player with the highest Total Score at the conclusion of the Weekend Competition Period at issue will be the winner for that Track for that Weekend Competition Period. In any Weekend Competition Period, players are allowed two (2) losses (quit, power down, disconnect, or just losing) and can continue to play for the rest of that Weekend Competition Period. In the event of the third loss during that Weekend Competition Period, such player will no longer be permitted to play and their score for that Weekend Competition Period will be locked in at the Total Score at the time of the third loss.
4. Leaderboard Score/Ties/Game Play Disqualification/Streaming.
Leaderboard Score: As set forth above, the Game will determine each player’s GameScore for each Qualifying Game based on a combination of factors including the quality of their roster, the quality of their opponent’s roster, and the quality of their performance in the Qualifying Game. All Qualifying Games for which play is commenced and completed in accordance with these Official Rules shall count toward player’s Total Score on the Leaderboard.
Tiebreakers: In the event of a tie in any Track at the conclusion of the Weekend Competition Period:
Losses: The player from among those tied who has fewest losses will be determined to be the winner;
Number of Games Played: If there is still a tie, the player from among those who are still tied who played the fewest number of Qualifying Games will be determined to be the winner.
Head-to-Head Record: If there is still a tie and if the tied entrants played each other, the winner of that Qualifying Game will be determined to be the winner; and
First to Score: If there is still a tie, the player from among those tied who first achieved the winning GameScore will be determined to be the winner.
Game Play Disqualification: Players may be disqualified if Sponsor detects that player did not complete the game by quitting, powering down, disconnecting from the internet, or excessive penalties. For clarity, if a player disconnects, the player may be disqualified and banned from that Weekend Competition Period. A ban would eliminate the player from participating in any further Qualifying Games during that Weekend Competition Period. In the event that player disconnects from the server at any point during a Qualifying Game, that player will be deemed the loser of that Qualifying Game, regardless of whether such disconnection is intentional and/or is the fault of the disconnecting player, or caused by other reasons not attributable to Sponsor.
5. Contest Play. Players must strictly adhere to all game play guidelines, the Terms of Service and these Official Rules or risk the possibility of disqualification.
Players must conduct themselves in a sportsmanlike manner, maintaining a friendly and polite demeanor to competitors and to other players of the Contest. Players who engage in unsportsmanlike, disruptive, annoying, harassing or threatening conduct or violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means, in Sponsor’s sole discretion, will be disqualified. Players who violate the Microsoft Services Agreement, the PlayStation Network Terms of Service and User Agreement, or any other terms of use for the platforms may be disqualified in Sponsor’s sole discretion. Sponsor will interpret these Official Rules and resolve any disputes, conflicting claims or ambiguities concerning the Official Rules or the Contest and the Sponsor’s decisions concerning such disputes shall be final. Sponsor may prohibit a player from participating in the Contest or winning a prize if, in its sole discretion, Sponsor determines that said player is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other players or Sponsor’s representatives.
Sponsor, in its sole discretion, reserves the right to change the GameScore in the event that it detects a fault or anomaly, including in the event of computer or technical issues. Additionally, Sponsor, in its sole discretion, reserves the right to disqualify or remove any player for any reason. This decision could be made based on the Sponsor’s judgment that the game reported the result incorrectly or the players tampered with the game software or hardware to manipulate the reported points or score.
6. Prizes.
Track 1 Prize (one (1) per Weekly Contest Period, to a total of 47): $10,000 (U.S.) (awarded in the form of a check in US dollars or Bank Transfer and subject to the exchange rates at the time the check is cashed or transfer is made) and 1,000,000 Virtual Currency (deposited into winner’s 2K account). Virtual Currency has no monetary value, it must not be used outside of the Game and cannot be exchanged for any amount of money. Terms and conditions, including the Terms of Service, apply to use of virtual currency as set forth by 2K.
Track 2 and Track 3 Prize (one (1) per Track per Weekly Contest Period, to a total of 47 per Track): 1,000,000 Virtual Currency (deposited into winner’s 2K account). Virtual Currency has no monetary value, it must not be used outside of the Game and cannot be exchange for any amount of money. Terms and conditions, including the Terms of Service, apply to use of virtual currency as set forth by 2K.
General Prize Conditions and Restrictions.
Prizes will be delivered or paid to the winner (as applicable) within thirty (30) days of the winner’s submission of a valid prize claim (see section 7). Bank transfers will be made to the bank account of the winner notified during the prize claim process. Checks will be sent to the winner at the postal address notified during the prize claim process.
The prize may be subject to tax. In countries where Sponsor must provide the tax authorities with the taxed sum, Sponsor will provide the winner with the prize money after it has deducted the tax required by law (if applicable). The winner will sign all the appropriate tax documentation and forms requested by law. Failure to provide the Sponsor with all the tax related documentation, forms and/or signatures, will result in the disqualification and forfeiture of the prize.
Prizes are not transferable. No substitutions or exchanges of any prize or cash equivalent of any non-cash prize will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Prizes will be awarded throughout the Contest Period.
Nothing in these Official Rules limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, all Prizes and all parts thereof are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), except where prohibited by law. ALL FEDERAL, STATE, PROVINCIAL AND LOCAL TAXES, ANY APPLICABLE SOCIAL CONTRIBUTIONS, FOREIGN EXCHANGE RESTRICTIONS AND OTHER COMPLIANCE REQUIREMENTS ASSOCIATED WITH THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNERS AND WINNERS RESIDING OUTSIDE OF THE U.S. WILL BE REQUIRED TO REPORT AND PAY ANY APPLICABLE INCOME TAXES AND COMPLETE ANY FOREIGN EXCHANGE AND OTHER APPLICABLE PROCEDURES RELATED TO THE PRIZE.
7. WINNER REQUIREMENTS.
ALL POTENTIAL WINNERS MUST BE VERIFIED BY SPONSOR TO ENSURE ELIGIBILITY PRIOR TO BEING DECLARED A WINNER AND/OR RECEIVING ANY PRIZE.
Sponsor may require potential winners to participate in background checks and/or provide any necessary information Sponsor deems required to determine eligibility and/or award the prize. Failure to comply with this requirement and/or assist Sponsor to conduct such background check may result in disqualification of a potential winner and may result in selection of an alternate winner for the Weekly Contest Period at issue. Sponsor also reserves the right, in its sole and absolute discretion, to disqualify a potential winner if the Sponsor determines, in its sole and absolute discretion that allowing that individual to participate in the Contest or awarding them a prize might reflect negatively on the Contest, Sponsor, and/or the NBA Entities. Factors that may result in disqualification, include, without limitation, conviction of a felony or misdemeanor, or any other criminal or civil offense as determined in the sole and absolute discretion of the Sponsor or, if Sponsor determines, in its sole and absolute discretion, that awarding a prize to such individual may reflect unfavorably on the Contest, Sponsor, and/or the NBA Entities.
To the fullest extent permitted by law, all potential winners will be notified via direct message within seven (7) days of the end of the relevant Weekend Competition Period and will be required to complete and return documents, including an Affidavit/Declaration of Eligibility and Liability/Publicity release and rights transfer document, and, where applicable, appropriate tax forms (or, in relation to Great Britain, an acknowledgement or such other documents as the Sponsor may specify) and return via email and/or as otherwise instructed by Sponsor to Sponsor within ten (10) days of receipt. Failure to return such documents in the time frame required by Sponsor may result in forfeiture of the applicable prize. Winners are responsible for ensuring return of all required materials; proof of sending will not be considered proof of receipt by Sponsor.
If any prize or prize notification messages are returned as undeliverable, or a winner does not respond in the time frame required by Sponsor, or, to the extent permitted by applicable law, refuses to execute the required documents, or rejects his/her prize (or any part thereof), or in the event of noncompliance with these Official Rules or Contest requirements, the prize will be forfeited and may be awarded to the next runner-up for the Weekend Competition Period at issue, as determined by Sponsor in its sole and absolute discretion. In the event of prize forfeiture, no compensation will be given.
8. Collection of Information. Sponsor will be collecting personal data about players online, in accordance with Sponsor’s privacy policy and any applicable laws. Please review the Sponsor’s privacy policy at https://www.take2games.com/privacy/. The Contest is hosted on servers in the United States, and the personal information you provide may therefore also be subject to the laws of the United States. By participating in the Contest, players hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and uNDERSTAND Sponsor’s privacy policy.
Players are hereby informed that your personal data will be processed by the Sponsor for the participation management and in accordance with the applicable personal data protection regulations. Sponsor shall process the aforementioned personal data with the aim of managing your participation in the Contest until its end, without prejudice to the possible conservation of the aforementioned data until (i) the expiration of the statute of limitation of the legal obligations that may fall on the parties or (ii) the statute of limitation of the actions that may be exercised by the parties within the framework of their contractual relationship. In particular, the players’ personal data will be used to (a) verify the eligibility of the winners, (b) contact the winners, (c) allocate the prizes.
The personal data collected in connection with the Contest may be processed, transferred, and stored in the United States of America and other countries that may not have privacy laws equivalent to the country where you reside. We take steps to apply appropriate safeguards when we transfer that information. More information about international transfers can be found in our Privacy Policy.
Depending on your location, you may have certain rights over your personal data. Information about how to exercise these rights can be found in our Privacy Policy.
9. General Release. BY PARTICIPATING IN THE CONTEST, AND SUBJECT TO ANY NON-EXCLUDABLE GUARANTEES, ALL PLAYERS, AND WINNERS TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAWS, RELEASE THE SPONSOR, THE NBA ENTITIES, ALL OTHER CONTEST PARTIES, AND ANY OF THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SPONSORS, AND AGENTS, INCLUDING ADVERTISING AND PROMOTION AGENCIES (COLLECTIVELY, “RELEASED PARTIES”), FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, MORAL DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN CONTEST OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF ANY PRIZE OR PARTICIPATION IN ANY CONTEST-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT (INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF MORAL RIGHTS), TRADEMARK INFRINGEMENT OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION, AND AGREE NOT TO MAKE ANY CLAIMS AGAINST THE RELEASED PARTIES IN RESPECT THEREOF, INCLUDING, WITHOUT LIMITATION (I) ANY CONDITION CAUSED BY EVENTS BEYOND SPONSOR'S CONTROL THAT MAY CAUSE THE CONTEST TO BE DISRUPTED OR CORRUPTED; (II) ANY INJURIES, LOSSES, ILLNESS, LITIGATION OR DAMAGES (COMPENSATORY, DIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHERWISE) OF ANY KIND CAUSED BY PLAYER’S OWN NEGLIGENCE ARISING OR RESULTING, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE AWARDING, DELIVERY, ACCEPTANCE, USE, MISUSE, POSSESSION, LOSS OR MISDIRECTION OF A PRIZE OR PARTICIPATION IN THIS CONTEST OR IN ANY ACTIVITY OR TRAVEL RELATED THERETO OR FROM ANY INTERACTION WITH, OR DOWNLOADING OF, COMPUTER CONTEST INFORMATION; AND (III) ANY PRINTING OR TYPOGRAPHICAL ERRORS IN ANY MATERIALS ASSOCIATED WITH THE CONTEST. Sponsor's decisions in all respects relative to the Contest are final.
In relation to players from Great Britain, Singapore, Thailand, Germany, Greece, Republic of Ireland, Portugal, and France, the above provisions apply to the fullest extent permissible by law, save that, to the extent English, Singapore, Thai, Hong Kong, German, Greek, Irish, Portuguese, or French law applies, nothing in these Official Rules shall exclude or limit the Sponsor or any other Released Party’s liability for: (i) fraud or fraudulent misrepresentation; (ii) death or personal injury caused by negligence; or (iii) any other type of liability which may not be lawfully excluded or limited. In relation to players from South Africa, the above provisions apply to the fullest extent permissible by law, save that, to the extent South African law applies, nothing in these Official Rules shall exclude or limit the Sponsor or Released Parties’ liability for gross negligence.
This clause does not apply to Chilean consumers in matters related to the Consumer Protection Law.
10. General Conditions. By entering the Contest, all entrants accept and agree to be bound by these Official Rules and the decisions of the Sponsor. In case of dispute of the identity of any player, including winners, game play will be deemed made by the authorized account holder of the email address associated with the NBA 2K Account. “Authorized account holder” is defined as the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Players must keep their email address information up to date and inform Sponsor of any changes of the relevant email address.
To the fullest extent permitted by applicable law, Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to player’s or any other person’s computer or other device relating to or resulting from participating in this Contest or downloading any materials in this Contest.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Contest or any Weekly Contest Period (or portion thereof) should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud, epidemics, pandemics, or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor may select the winner(s) for the Track(s) at issue based on game play up to time of such action or as otherwise deemed fair and appropriate by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest or any web sites, platforms or consoles associated with this Contest. Sponsor may prohibit a player from participating in the Contest or winning a prize if, in its sole discretion, it determines that said player is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including but not limited to the use of automated entry programs, the use of automated entry devices, playing through the use of multiple 2K Accounts or 2K Sports accounts, or by participating in, or benefiting from, a syndicate, group or block playing process or system), or intending to annoy, abuse, threaten or harass any other players, players or Sponsor representatives.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITES, PLATFORMS OR CONSOLES ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Additional Conditions. Except where prohibited by law, each player, including all winners, grants the Released Parties the unconditional, perpetual and worldwide right and/or license to use the player’s name, address (city or county and state/province/territory only), likeness, photograph, biographical information, Team roster/ logo/name and prize information (if any) and/or statements about the Contest for any publicity, advertising and promotional purposes in connection with the Contest without additional compensation, in any media now known or hereafter invented, including but not limited to, on any and all Internet media, including Sponsor’s web sites and Sponsor’s Social Media Channels, and in-game on 2KTV, and via live stream (including, but not limited to, any 2K-owned live streams), and hereby releases the Released Parties from any liability with respect thereto.
Sponsor has the right to use all of player’s Team names, logos and uniforms in its advertising, marketing and publicity materials, in its sole and absolute discretion. In addition, Sponsor has the right to require an player to change its Team’s name, logo and/or uniform if such name, logo or uniform is deemed inappropriate or could violate the right of any third party, including, but not limited, to copyright, trademark or right of publicity or privacy, as determined by Sponsor in its sole discretion. Failure to comply with Sponsor’s request to change team name, logo and/or uniform in a timely manner may result in disqualification, in Sponsor’s sole and absolute discretion.
12. Governing Law, Disputes and Jurisdiction: AU, CH, EEA, UK. If you are habitually resident in Australia, Switzerland, Great Britain, or any Eligible Jurisdiction located in the European Economic Area, the terms of this Section 12 apply. If you habitually reside outside of these territories or jurisdictions, please see Section 13 below. This Agreement shall be governed by, and construed under, the laws of your country of residence without regard to conflict of laws rules. The exclusive jurisdiction for all disputes will be the competent courts of your country of habitual residence. For German residents: Sponsor is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Governing Law, Disputes and Jurisdiction: United States & Rest of World. If you are habitually resident in the United States or any Eligible Jurisdiction other than Australia, Switzerland, Great Britain, or any Eligible Jurisdiction located in the European Economic Area, the terms of this Section 13 apply. If you habitually reside in Australia, Switzerland, Great Britain, or any Eligible Jurisdiction located in the European Economic Area, please see Section 12 above.
(a) Disputes. Except where prohibited by law: (a) As a condition of participating in this Contest, player agrees that any and all disputes which cannot be resolved between the any of the Released Parties and player or his/her representatives, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective; (b) Further, in any such dispute, under no circumstances will player be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than player’s actual out-of-pocket expenses (e.g., costs associated with entering this Contest), and player further waives all rights to have damages multiplied or increased; and (c) The arbitration shall be conducted in the State of New York, in the City of New York, County of New York, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
(b) Governing Law and Jurisdiction. This promotion is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of player and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Disputes Section of these Official Rules, shall take place in the courts of the State of New York, in the City of New York, County of New York.
(c) For Chilean residents: This clause does not apply to Chilean consumers in matters related to the Consumer Protection Law.
14. Miscellaneous. The invalidity or unenforceability of any provision herein shall not affect in any way the validity and enforceability of any other provision in these Official Rules. Player’s participation in the Contest is also subject to the 2K Games’ Terms of Service available at https://www.take2games.com/legal/.
IN THE EVENT THERE IS A DISCREPANCY OR INCONSISTENCY BETWEEN DISCLOSURES OR OTHER STATEMENTS CONTAINED IN ANY CONTEST MATERIALS AND THE TERMS AND CONDITIONS OF THE OFFICIAL RULES, THE OFFICIAL RULES SHALL PREVAIL, GOVERN AND CONTROL.
15. Winners List. Sponsor shall post the Winners list on the Contest Site located at https://nba.2k.com/2k26/king-of-the-court/. Any entrant from Great Britain may request that the amount of information about them published in the way described above be reduced, by contacting the Sponsor using the contact details above. In these circumstances, the entrant acknowledges that the Sponsor may nevertheless disclose the relevant information, and the entrant’s entry, to the United Kingdom’s Advertising Standards Authority (and/or any other competent authority) if required to do so. By way of example, this may happen if the Sponsor is required to demonstrate that it has awarded any advertised prizes.
